Terms of Service

1. Eligibility

• You must be at least 18 years of age to use the Platform.
• By using the Platform, you represent that you have the legal capacity to enter into these Terms.
• If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• One person may create multiple profiles under a single account for different businesses or roles.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Platform Services

Boostify provides the following services:

• Digital Business Cards — create and share digital profiles with contact information, social links, QR codes, and custom sections
• Posters — ready-made occasion and business creatives, branded with your details through frames, for you to download and share
• Contacts & Reminders — keep your customer contacts and get reminders for birthdays, anniversaries and occasions
• Analytics — track profile views, link clicks, and visitor engagement
• Commerce Features — display products/services with WhatsApp-based Buy and Enquire buttons
• Team Management — multi-profile support, staff roles, and permissions

4. Acceptable Use

You agree NOT to use the Platform to:

• Upload or display illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity
• Engage in fraud, phishing, or deceptive practices
• Distribute spam, unsolicited messages, or malware
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Scrape, crawl, or use automated tools to extract data from the Platform without written permission
• Interfere with or disrupt the Platform or its infrastructure
• Violate any applicable law, regulation, or third-party rights (including intellectual property rights)
• Use the Platform to promote illegal activities, hate speech, or discrimination
• Upload content that infringes on copyrights, trademarks, or other intellectual property

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, without prior notice.

5. User Content

• Ownership: You retain ownership of all content you create and upload to the Platform (profile data, images, text, logos, contacts).
• License to Us: By uploading content, you grant Boostify a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content solely for the purpose of operating and providing the Platform services.
• Public Profiles: Content on published profiles is publicly accessible. You are solely responsible for the content you choose to make public.
• Contacts: You are responsible for having the consent of the people whose details you add to your contacts.
• Removal: You can delete your content at any time. Deleted content is removed from our servers within 30 days, except where retention is required by law.

6. Posters, Frames & Creatives

• Creatives and frames provided by Boostify are licensed to you for promoting yourself or your business, personally and commercially, while your account is in good standing. Which creatives, formats and features you can use depends on your plan.
• Posters you have downloaded remain yours to use after your plan ends.
• You may not resell, redistribute or sublicense Boostify creatives or frames as standalone assets, or remove the Boostify watermark where your plan shows one.
• You are responsible for the logos, photos and text you place on a poster, and must have the right to use them.

7. Plans & Payments

• Boostify offers a Free plan and paid plans. A paid plan is bought for a fixed period (monthly or yearly, as chosen at checkout) with a one-time payment.
• Plans do not renew automatically. When the period ends, the account moves to the Free plan unless you pay again. We remind you by email 7 days and 1 day before the end.
• Renewing the same plan before it ends adds the new period after the current one. Switching to a different plan starts it immediately.
• Prices are in Indian Rupees (INR) and exclude GST. GST at the applicable rate is added at checkout and shown before you pay.
• A GST tax invoice is issued for every payment and is available under Settings → Billing. If you provide a GSTIN, it is printed on the invoice so you can claim input tax credit. You are responsible for the billing details you enter being correct.
• Payments are processed by Razorpay. We do not receive or store your card, UPI or bank login details.
• Introductory offer prices apply only for the number of periods stated with the offer.
• We may change prices at any time. A change never affects a period you have already paid for.
• Payments are non-refundable except as set out in our Refund & Cancellation Policy.

8. Free Plan Limitations

The Free plan provides access to core features with certain limits (for example the number of profiles, posters and storage). Free plan features may change at our discretion. Public pages on the Free plan may show a small "Powered by Boostify" note.

9. Intellectual Property

• The Boostify name, logo, website design, application code, creatives, frames, and all related intellectual property are owned by Noyyal Technologies and protected under applicable intellectual property laws.
• You may not copy, modify, distribute, or reverse-engineer any part of the Platform without written permission.
• All trademarks, service marks, and trade names used on the Platform are the property of their respective owners.

10. Third-Party Services

The Platform uses third-party services including Google Sign-In, Razorpay (payments), and email and SMS providers (for one-time codes and notifications). Your use of these services is subject to their respective terms and privacy policies. Boostify is not responsible for the practices or availability of third-party services.

11. Service Availability

• We aim to keep the Platform available at all times, but do not guarantee uninterrupted service.
• We may carry out scheduled maintenance, and will try to do so at low-traffic hours with notice where possible.
• We are not responsible for failure or delay caused by events beyond our reasonable control, such as natural disasters, power or network failures, or government action.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Any defects will be corrected within a specific timeframe
• The Platform will meet your specific requirements
• Results obtained from the Platform will be accurate or reliable

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOSTIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Boostify in the 12 months preceding the claim, or INR 1,000, whichever is greater.

14. Indemnification

You agree to indemnify and hold Boostify harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

15. Termination

• You may delete your account at any time from Settings → Security in the app or on the website, or by emailing [email protected]. See Delete Account for what is deleted and when. Deleting an account does not refund an active plan.
• We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or upon legal requirement.
• Upon termination, your right to use the Platform ceases immediately. Your data will be handled as described in our Privacy Policy.
• Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will survive.

16. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify you via email or in-app notification. Your continued use of the Platform after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the Platform.

17. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019.
• Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Tiruppur, Tamil Nadu, India.
• Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through negotiation within 30 days of written notice.

18. General Provisions

• Entire Agreement: These Terms, along with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Boostify.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Failure to enforce any provision shall not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. Boostify may assign its rights and obligations without restriction.
